1. Introduction and Acceptance

HomeMan Properties Private Limited (CIN: U68200KA2024PTC183062) ("Company," "HomeMan," "we," "us," or "our") operates a digital platform offering comprehensive real estate solutions in India, including property management, rental facilitation, sales, Comfort Living (PG/Hostel), HomeMan Express and related technology-enabled services.

These Terms of Use ("Terms") constitute a binding agreement between the User ("you," "your," "customer," or "client") and HomeMan Properties Private Limited. They govern access to: (a) the website www.homeman.in, (b) the HomeMan mobile applications (iOS & Android), and (c) all services, features, and tools provided through the platform.

By visiting, registering, or using the platform, you confirm that you are 18 years of age or older, legally competent to contract in India, and agree to be bound by these Terms. If you represent an organization, you confirm that you are duly authorized to bind such organization.

2. Definitions

Platform: The website, mobile applications, and other digital services operated by HomeMan.

Services: Real estate and associated services offered under the Platform, without limitation.

Owner: A property owner or legally authorized representative.

Tenant/Resident: A user availing rental, housing, or accommodation services.

User Content: Data, information, or materials uploaded, submitted, or shared by a user.

Confidential Information: Non-public information disclosed in connection with services.

Force Majeure: Events beyond reasonable control of the parties as recognized under Indian law.

3. Platform Usage

HomeMan grants you a limited, non-exclusive, revocable license to use the Platform for lawful purposes connected to services provided.

You agree not to use the Platform for unlawful, fraudulent, or harmful activity; upload viruses or malicious code; impersonate others or provide false information; extract, scrape, or copy data without authorization; or breach any Indian laws or regulations while using the Platform.

User Content: You are solely responsible for the legality and accuracy of content uploaded. Content must not be defamatory, infringing, or misleading. By uploading, you grant HomeMan a limited license to display and use such content solely for service delivery purposes.

Availability: We strive to provide uninterrupted access but do not guarantee permanent availability. Temporary interruptions for maintenance or technical reasons may occur.

4. Services

HomeMan provides multiple service categories including Property Management, Property Rentals (Long-term), HomeMan Express (Short-term Rentals & Service Apartments), Property Sales Facilitation, and Comfort Living (Student/Professional Housing & PG/Hostel Management). The scope, process standards, and user obligations for these services may be further detailed in service-specific agreements in addition to these Terms.

5. User Accounts

To register, users must provide valid identification details, contact information, and agree to these Terms and the Privacy Policy.

Users are responsible for maintaining the security of login credentials, keeping profile information accurate, and promptly reporting unauthorized account access.

We may suspend or terminate user accounts for breach of Terms, unlawful activity, misrepresentation, or security reasons.

6. Privacy and Data Protection

We collect, process, and store user data in compliance with the Digital Personal Data Protection Act, 2023, Information Technology Act, 2000, and allied Indian laws. We implement reasonable security standards, including encryption and restricted access, to safeguard user data.

Personal information may be shared only with authorized service partners, legal authorities, or as otherwise mandated by law. Users may request access, correction, or deletion of personal data in accordance with applicable legal rights.

7. Intellectual Property

All intellectual property rights in the brand, logo, platform design, software, documentation, and related proprietary materials belong exclusively to HomeMan. Users may not copy, alter, reverse engineer, or distribute any proprietary content without our prior written consent.

Users retain ownership of content submitted but grant HomeMan a limited use-license to provide services.

8. Liability and Disclaimers

The Platform and Services are provided "as-is" without warranties of uninterrupted access or error-free performance. HomeMan shall not be liable for losses arising from third-party integrations, system interruptions, inaccurate user data, or force majeure events.

Users agree to indemnify HomeMan against losses, claims, or damages resulting from their breach of these Terms or unlawful actions.

9. Compliance and Legal Framework

HomeMan adheres to the Real Estate (Regulation and Development) Act, 2016 (RERA), Companies Act, 2013, Consumer Protection Act, 2019, applicable municipal and housing laws, and other relevant Indian regulations. Users are required to comply with all applicable laws when availing HomeMan services.

10. Dispute Resolution

We maintain an internal grievance redressal mechanism, with responses typically within 72 hours of receipt. If disputes remain unresolved, parties agree to refer matters first to mediation, failing which they shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.

The venue for arbitration shall be Bengaluru City, Karnataka, India. Courts in that jurisdiction shall have exclusive authority for interim or residual proceedings.

11. General Provisions

These Terms constitute the entire agreement and supersede any prior arrangements. If any provision is found invalid, the remainder shall remain enforceable. Neither failure nor delay to enforce any right shall be deemed a waiver.

Provisions relating to intellectual property, confidentiality, liability, and dispute resolution shall survive termination. We may update these Terms with prior notice; continued use of the Platform indicates deemed acceptance.

By using the HomeMan Platform, you acknowledge that you have read, understood, and agreed to these Terms and that they form a legally binding agreement under the laws of India.
